What is First Colony Community Association?
It is a non-profit corporation registered with the State and managed by a duly elected Board of Directors. Its purpose is to maintain all common areas and to govern the community in accordance with the provision of the legal documents: Covenants, Conditions, & Restrictions, Bylaws, and Articles of Incorporation.
What neighborhoods are included in FCCA?

What are the “Covenants, Conditions and Restrictions” (CCR’s)?
The Covenants, Conditions & Restrictions (CC&R's) are the governing legal documents that set up the guidelines for the operation of the planned community as a non-profit corporation. The CC&R's were recorded by the County recorder's office of the County in which the property is located and are included in the title to your property. What are the Bylaws?
The Bylaws are the guidelines for the operation of the non-profit corporation. The Bylaws define the duties of the various offices of the Board of Directors, the terms of the Directors, the membership's voting rights, required meetings and notices of meetings, and the principal office of the Association, as well as other specific items that are necessary to run the Association as a business. The Board is responsible for directing the operations of and planning for the future of FCCA and its membership to ensure that its objective, as stated in the Declaration and By-Laws, are met. The Board consists of seven members elected by the property owners of FCCA for staggered three-year terms. The Board meets regularly and meetings are open to the public. The Board operates under Policy Governance, which ensures a moral obligation of the Board to the membership as well as a linkage to the membership.
Are there any other rules?
The developer of First Colony, Sugar Land Properties, Inc., established Rules and Regulations for First Colony Community Services Association, as provided for in the CC&R's and adopted by the Board of Directors. In addition, Architectural Guidelines were established with procedures for submitting requests to make exterior changes to your property and/or home. Such changes may include patio covers, decks, landscaping, exterior color changes or extensive interior changes and additions. These rules and guidelines are set up to maintain the aesthetic value and integrity of the community on behalf of all owners, and with intention of protecting the market value of your investment as well. Violations of these rules may result in action by the Board of Directors, could involve a fine, or as a final step, could involve legal action. In addition, if you proceed with an exterior improvement or change, without written approval of the Modifications or Covenants Committee, as applicable, you will be required to remove or correct the alteration and/or be fined for the violation.
FCCA has a Compliance Department staff that is responsible for the enforcement of deed restrictions. Most importantly, our staff is dedicated to assisting the members of the Association by providing helpful information on how they can help ensure that First Colony remains an attractive and viable community.

How is FCCA managed?
FCCA maintains a management staff under the leadership of an Executive Director who is appointed by the Board of Directors. The staff is responsible for the day-to-day operations of the Association and works closely with the Board of Directors, Neighborhood Reps, and Committees/Task Forces. Who is my Neighborhood Representative?
Each residential neighborhood within FCCA elects up to three (3) representatives (Neighborhood Reps) to serve a one year term. Neighborhood Reps are one of the most vital links in the communication chain between members and the Association. Is there a monthly Association newsletter?
FCCA mails a monthly newsletter, First Colony Compass, to all residential and commercial members. The newsletter provides current news on community issues/events, up-to-date Association business, helpful articles, and other news stories. To offset the cost of producing the newsletter, advertising space is available.
What does the FCCA website have to offer?
The FCCA website – www.firstcolony.org – is your source for all Association information. For up-to-date news to downloading Modification or Certificate of Compliance forms, the website offers a plethora of information to make your life easier. The site is ‘user-based’ with members having the ability to log on to become a site user. This feature allows FCCA the ability to send out important information in an efficient and immediate manner through an e-mail notification. To log on, please visit www.firstcolony.org.
Buying / Selling Your Property
What is a Certificate of Compliance (COC)?
In order to improve deed restriction compliance, the Certificate of Compliance (COC) program was developed which requires that all new and existing property sales must be preceded by an on-site inspection to check for deed restriction violations or non-compliance with the approved construction plans. This inspection is done by a FCCA Compliance Inspector, at which time a Certificate of Compliance (COC) or Non-Compliance (CONC) will be issued to the seller of the property. In some instances, a COC with provisions will be issued.
A COC inspection must be requested in writing by use of a COC Request Form. This form must be submitted at least 14 business days prior to the scheduled sale or conveyance of the property. Earlier requests are encouraged. A charge of $75 must be paid prior to the inspection being completed. To review FCCA's COC Policy or download a COC form, please visit www.firstcolony.org.
Modifications to House and/or Property
Do I need to get approval for any exterior house modification?
In order to ensure that exterior improvements to properties are in harmony with the neighborhood and do not detract from property values, all exterior modifications must meet FCCA guidelines and/or be approved in advance by the Modifications Committee.
The Board of Directors has adopted written guidelines for modifications to assist the property owner in planning their project. FCCA has developed a detailed Modifications Guide which outlines guidelines for common modifications. To view the entire Modifications Guide, please visit www.firstcolony.org. For a quick reference – the below modifications require written approval prior to commencing work. A Modification Application (available at www.firstcolony.org) along with the site plan and specifications must be submitted for approval.

For a quick reference – the below modifications DO NOT require prior approval. However, if there is a deviation from the guideline, an approval is necessary or it will be considered a deed restriction violation and may be subject to a fine and/or removal.

First Colony Parks & Recreation
What programs are offered through FirstColonyParks & Recreation?
Residents and non-residents may sign up for the various First Colony Parks & Recreation classes, camps, leisure courses, etc. offered on a regular basis. Program times, costs, days, and schedules vary. Programs are offered for youth and adults. The First Colony First monthly newsletter typically publishes the most current programs each month. In addition to leisure programs, First Colony Parks & Recreation hosts a variety of special events each year. These annual events include the following:

Can I use an FCCA pool?
FCCA members have access to ten (10) neighborhood swimming pools. Pool tags are required for entry to all FCCA pools. Pool tag costs are included in the yearly assessment and may be picked up at the main office starting in mid-April each year. Residents must show proof of residence (i.e. drivers license or bill) to pick up pool tags. One (1) pool tag per household member with a maximum of four (4) pool tags per household. Each pool tag is valid for one (1) resident and one (1) guest. The Aquatic Center pool does not have lifeguards and a $100.00 deposit is required to recieve a key for entry. What are the pool hours?
For current pool hours, look for the Parks & Recreation Summer Guide that is mailed every April to all residents. Pool hours are also available at www.firstcolony.org.
How do I rent a pool or Heritage Colony clubhouse for a private party?
FCCA members are able to reserve the 9 neighborhood pools (excluding the Aquatic Center) and Heritage Colony Clubhouse for private parties during non-operating or program hours. For more information, please call First Colony Parks & Recreation at 281-634-9555 or visit www.firstcolony.org.
How do I get a key to use FCCA tennis courts?
Tennis court keys are available for members for the following tennis courts: Lexington Colony, Woodstream, and Creekshire. Tennis keys available at the FCCA office, 4350 Austin Parkway, Monday – Friday, 8:00 am – 5:00 pm, and Saturdays, 10:00 am – 4:00 pm. A key requires a $20 deposit which is refundable if returned to FCCA when no longer needed. What are the hours of the AquaticCenter Playground water spray area?

The Aquatic Center Spray Park operates from the beginning of Daylight Savings Time until then end of Daylight Savings Time (generally mid-April through early Oct.), 7 days a week. Spray Park hours are 9:00 am - 8:30 pm. Opening and closing of the spray area is dependent on the weather and dates are tentative. The playground (non-water) area is open year-round.
Can I reserve an FCCA park or playground?

Paying Your Assessment
What does my assessment cover?
The three components are: General, Recreation, and Trash/Recycling. Depending on the type and location of your property within FCCA, your bill will include one, two, or all three assessment components.
The GENERAL portion is paid by all residential and commercial members and covers most FCCA expenses including landscape, park and lake maintenance, street lighting, deed restriction enforcement, financial management, office expenses, insurance, legal services, taxes, and general and capital projects. The RECREATION portion is only paid by single-family residential members and pays for the operation and maintenance of FCCA pools, tennis courts, parks, recreation reserves, and capital projects. The TRASH/RECYCLING portion is only paid by single-family residential members in Missouri City and pays for twice per week curbside trash pick-up and once per week recycling pick-up. Some neighborhoods pay an additional Neighborhood Assessment for special services or features.
When are assessment billings mailed? When is my payment due?
Assessments are billed annually. The assessment statement is mailed in mid-November and due January 1. Full payment must be postmarked by January 31 to avoid interest and late charges. The envelope must be marked with the owner’s return address and account number. If you did not receive your assessment in the mail by early December, please contact the Accounting Department at 281-634-9589.

FCCA can approve installment plans under a written agreement if a property owner is unable to pay the assessment in full by the due date. Generally, a payment plan for members with no previous collection problems would allow for up to four monthly installments. With a payment plan, interest (10% per annum or 0.83% on the outstanding balance on the last day of the month) and reduced late fees continue to accrue. While the plan is in effect, other collection steps are suspended, provided the member stays current with scheduled payments. Members must either pay their assessment in full by the noted deadline or they may request to pay their assessment through the approved Payment Plan process. Refer to the two previous questions for additional details.
Can I pay my assessment with a credit or debit card?
At this time, this option is not currently available to members. FCCA does accept credit/debit cards (Master Card/VISA) for fees related to programs, newsletter advertising, and Certificate of Compliance and Resale Certificates. Please note that if paying your assessment in person, cash is not accepted in the office on Saturdays only.

Trash & Recycling
What are the requirements for solid waster pick-up, including heavy trash/limbs/appliances? What items are not accepted?
COLLECTION INFORMATION
- Republic Services collection hours are from 7 a.m. to 6:30 p.m.
- Trash and recycling bins must be set out by 7 a.m.
- All solid waste shall be placed no farther than six (6) feet from the curb for collection.
- Heavy trash, appliances and lawn trimmings will be picked up on either collection day. Refrigerators and freezers must have the doors removed before being placed at the curb for collection. This is a safety measure to ensure that children do not get trapped inside. Allied Waste has 24 hours to remove appliances with refrigerants.
- Up to 15 cubic yards of brush (15 piles 3' x 3' x 3') will be picked up each collection day.
- Re-usable residential receptacles must have a capacity of no less than 20 gallons but no more than 40-gallons nor weigh more than 60 pounds with trash.
- Recyclables are collected once a week. See the Neighborhood Service Schedule for your recycling schedule.
Currently The Association administers the contract with Republic Services for all Missouri City members of FCCA while the City of Sugar Land coordinates a contract for their residents. Should you ever experience any problems or have questions about your service, Republic Services can be contacted directly by phone at 713-937-9955. Please note that the contractor for The Enclave at Cartwright is handled by W.A.C. through M.U.D. #42. Customer service can be contacted by phone at 281-368-8397.
UNACCEPTABLE CURBSIDE ITEMS
Allied Waste will not pick up: automobile parts, tree stumps and logs larger than 4’ in length or greater than 4” in diameter, dirt, construction debris, concrete, bricks, rocks, roofing materials, metal poles, trampoline frames, hazardous chemicals, lead batteries, motor oil, tires, gasoline, paint, landscape timbers over 2’ long or fence pickets with nails.

Back door service is provided under a separate contract paid for by various neighborhoods in FCCA (i.e. Sweetwater). Trash cans/bags must be visible from the street. Allied Waste will not pick up garbage from behind a closed door/gate or from inside a shed, garage, or any type of room.
